PHIPA Compliance for Ontario Dental Offices: A Practical IT Guide

Every dental office in Ontario is a health information custodian under the Personal Health Information Protection Act (PHIPA). This means your practice has legal obligations around how patient health information is collected, stored, accessed, and protected — obligations that extend directly to your IT systems.

PHIPA is not a set of abstract principles. It has concrete implications for how your network is configured, how your workstations are managed, how patient records are stored, and what you must do if a data breach occurs. This guide translates PHIPA’s requirements into plain-language IT actions that every Ontario dental office can understand and implement.

What Is PHIPA and Who Does It Apply To?

PHIPA is Ontario’s health privacy law, governing how personal health information (PHI) must be handled by health information custodians — a category that includes all dental offices, regardless of size.

Personal health information under PHIPA includes patient names, contact information, health history, dental records, X-rays, treatment notes, and insurance information. If your practice collects any of this — and every dental office does — PHIPA applies to you.

PHIPA is enforced by the Information and Privacy Commissioner of Ontario (IPC). Violations can result in mandatory breach reporting, regulatory investigations, public orders, and fines. More practically, a data breach at a dental office can require notifying every affected patient — a process that damages the trust your practice depends on.

What PHIPA Requires From Your IT Systems

PHIPA requires health information custodians to implement “reasonable” technical safeguards to protect patient data. While the legislation does not specify exact technologies, the IPC has published guidance that translates into the following IT requirements:

Encryption at rest and in transit. Patient records stored on workstations, servers, or in the cloud must be encrypted. Patient data transmitted over email or networks must be encrypted in transit. This rules out sending X-rays or treatment notes as unencrypted email attachments.

Access controls. Only authorised staff should be able to access patient records, and only the records relevant to their role. Shared logins — one username and password used by multiple staff members — are a PHIPA violation. Each employee must have their own credentials.

Audit logging. Your systems should be able to tell you who accessed which patient record and when. This is called an audit log or audit trail. Not every dental practice management system creates these automatically — verify that yours does.

Breach response plan. PHIPA requires a documented process for identifying, containing, and reporting data breaches. This is not optional — and “we didn’t have a plan” makes a regulatory investigation worse, not better.

Physical security. Workstations at reception desks, treatment rooms, and hygienist stations should be configured to lock automatically after a short period of inactivity. Patient records should not be visible on screen when unattended.

The Five Most Common PHIPA IT Violations in Dental Offices

1. Shared login credentials. Multiple staff sharing the same username and password means there is no accountability for who accessed patient records. PHIPA requires individual accounts.

2. Unencrypted backups. Backing up patient data to an external hard drive that is not encrypted creates a serious risk if that drive is lost or stolen. The backup must be encrypted with a strong key.

3. Consumer-grade email for patient communication. Standard email is not encrypted in transit and should not be used to send patient health information without additional encryption. Secure messaging solutions or patient portals are the appropriate alternative.

4. No automatic screen lock. A workstation left logged in at reception or in a treatment room that displays patient information is a PHIPA vulnerability. Screens should lock automatically after five minutes of inactivity.

5. No breach response plan. If a breach occurs and you have no documented response process, you will be making decisions under pressure with no guidance. PHIPA investigations consistently identify the absence of a plan as an aggravating factor.

What a PHIPA-Compliant IT Setup Looks Like

A PHIPA-compliant dental office IT environment typically includes:

  • Individual user accounts for every staff member with strong passwords and multi-factor authentication
  • Workstations that automatically lock after 5 minutes of inactivity
  • Encrypted storage for all patient records (at rest)
  • Encrypted backups stored off-site or in secure cloud storage
  • Email encryption or a secure patient messaging system
  • Documented policies covering access control, password management, and breach response
  • A written breach response plan that identifies who is responsible for what steps
  • Vendor agreements (Business Associate Agreements) with any cloud or software provider who handles patient data

What to Do If You Have a Data Breach

If you discover or suspect a breach of patient health information, the steps are:

  1. Contain the breach. If a workstation is compromised, disconnect it from the network immediately.
  2. Assess what happened. Determine which records were affected, how many patients are involved, and how the breach occurred.
  3. Notify the IPC if required. PHIPA requires notification to the IPC if the breach “is significant” — a threshold that includes large-scale breaches and those involving sensitive information. Notify your privacy officer or legal counsel immediately.
  4. Notify affected patients. PHIPA may require notifying patients whose information was involved at significant risk.
  5. Document everything. Preserve evidence, document your response steps, and retain all communications.
